This Debt Resolution for SME’s is delivered in nine 30 minute video modules covering the individual topics of Overview of Debt Resolution, MARP, MARS, Personal Insolvency, Bankruptcy, Investment Property, SME Debt Resolution and Negotiation.

Case Studies are used to explain important points and a course workbook (provided in both Word and Excel) allows the participant to assist customers with their individual situation.

The Personal Insolvency Act 2012 constitutes a major change in how people with unsustainable debt will be treated under our legal system. The door is now open for a fair settlement between borrowers and their lenders/creditors. The draconian 12 year Bankruptcy term is being reduced together with other improvements which makes this an option worth considering.

Debt forgiveness is now possible but you must understand the rules to achieve it. This new programme, is delivered by the Irish Institute for Management Development (IIMD) in association with Fran Dalton BA, FCCA, QFA and the author of the book “Making a Deal With Your Bank – An Insider’s Guide to Managing Your Mortgage Debt”.

Fran, a business coach and trainer with 35 years experience in financial services brings a unique perspective to the topic. He assists SME’s in understanding the various processed from MARP, MARS, Insolvency and Bankruptcy from both the borrower’s and the lenders/creditor perspective. This will allow SME’s interact with their lenders and creditors in an informative, professional and constructive way

Knowledge and preparation are vital ingredients for success as there is no automatic debt forgiveness planned by the lenders or government agencies. If you don’t ask for debt forgiveness you will not receive it.

Course Outline: 
The course consists of 9 video modules plus additional learning resources covering the following areas:


  1. Module One: Introduction and Overview: Summary of all processes from the Central Bank of Ireland Mortgage Arrears Code to Personal Insolvency and Bankruptcy. It provides guidance on how to approach and provide initial background information to borrowers. It outlines the advantages of working with an adviser.  

  2. Module Two: Mortgage Arrears Resolution Process (MARP): An outline of the short term measures offered by lenders under the Code of Conduct on Mortgage Arrears 2013. This learning module outlines the process of MARP and the proposed solutions together with its likely impact on your living standards, car and home.

  3. Module Three: Mortgage Arrears Resolution Strategy (MARS): This module provides an outline of the longer term measures offered by lenders under the Code of Conduct on Mortgage Arrears 2013. This learning module outlines the three proposed solutions under the MARS process- Split Mortgages, Trade Down Mortgages and the Mortgage to Rent Scheme. It provides case study examples for all of these solutions together with discussing the likely impact they will have on your living standards, car and home.

  4. Module Four: Personal insolvency (Debt Settlement and Personal insolvency Arrangements): This module provides an outline of the two personal insolvency arrangements put in place by the new Personal Insolvency Act 2013 to deal with secured and unsecured debt over €20,000. This new ground breaking legislation is set to speed up the process of debt resolution. It is estimated that up to 20,000 people will take advantage of this legislation to achieve debt forgiveness in the next year. Understanding how the legislation works is an important first step to taking control of your outcome. This module seeks to provide this understanding on how the insolvency act works and the processes available. Also, how to assess its application to your situation and the possible impact on your living standards, pensions and home.

  5. Module Five: Bankruptcy: The new Insolvency Act 2012 introduced significant new amendments to the Bankruptcy Laws which will now make this option more attractive to those with unsustainable personal debt. This module provides an overview of Bankruptcy and its impact on a person’s lifestyle. The new amendments to the law is discussed together with the impact these could have on your living standards, pensions and your home. We also provide an introduction to the “Bankruptcy Tourism” for those considering a move to the UK to resolve their problem.  

  6. Module Six; Debt Relief Notices: This module provides an overview of Debt Relief Notices (DRN) which is the new process put in place to deal with unsustainable debt up to €20,000. There are many terms and conditions to this process and this module provides an insight on  how a person can approach dealing with small personal loan and credit card debts.

  7. Module Seven: Buy to Let Properties. This module provides an opportunity for borrowers to review their attitude to Buy to Let properties. Is there an opportunity to off load a property in negative equity, particularly if a borrower can achieve an acceptable deal on residual debt from their lender? The module looks at property valuations and through a number of case studies helps the borrower assess the right approach to Buy to Let Properties with their lender.

  8. Module Eight: SME borrowers: This module provides an approach for SME business owners with personal and business debt.  In particular SME business owners who are seeking to retain their family home. Different levels and types of debt which are often cross secured or secured by personal guarantee require an analytical approach to the business entity and debt commitments  

  9. Module Nine: Negotiating the Deal: This module will assist business professionals and SME business owners in carrying out a SWOT Analysis of the relative positions of the borrowers, lenders and creditors. The resolution of all debt problems involves negotiation and Professional Service Providers can assist their clients to focus on what they can offer their lenders and creditors. The key to a successful outcome is to be able to offer a better outcome to the best alternative available to lenders and creditors. This requires analysis and negotiation.

  10. Case Studies: These are provided throughout the course material together with a single case study which we have designed to demonstrate how our fictitious characters “Pat and Mary” can deal with their debt situation under each of the debt resolution processes. Using the case studies, we outline the financial implications from the different stakeholder perspectives (Secured Lender, Unsecured Lender, distressed borrowers etc) and demonstrates the range of possible financial solutions under the different options.

  11. Workbook: This workbook provides a number of worksheets to help SME’s with the analysis of their debt position. These include a Family Budget Worksheet, Asset and Liability Worksheet and Debt Assessment Worksheet. We also provide a quick assessment sheet to help professionals explain the approach taken by the Personal Insolvency Practitioners in assessing a borrower’s financial position in relation to personal insolvency. The workbook is provided in both a Word and Excel version to facilitate ease of printing.

  12. Blogs; The course is not designed to be exhaustive but will get you started on your journey to resolve your debt problem. As a student of IIMD you will receive free updates and comments on developing issues around personal debt and debt resolution.
